These Terms of Service ("Terms") govern your access to and use of FondCircle websites, products, apps, connected device features, and related services (collectively, the "Services").
By using the Services or purchasing products from FondCircle, you agree to these Terms and to any policies referenced in them.
EligibilityYou must be at least 18 years of age to directly register for an account or purchase products from FondCircle. By using the Services, you represent and warrant that you are 18 or older and that you have the legal capacity to form a binding contract in your jurisdiction.
Minors under 18 may not independently register or purchase. A parent or guardian who holds a valid account may create and supervise a dependent profile on behalf of a minor. The account holder is solely responsible for ensuring appropriate consent, supervision, and compliance with these Terms for any dependent profile.
Online StoreFondCircle offers products for sale through fondcircle.com. Product availability, pricing, promotions, descriptions, and shipping options may change without notice.
We may refuse, limit, or cancel orders at our sole discretion, including but not limited to orders that appear inaccurate, fraudulent, unauthorized, placed by resellers, or otherwise inconsistent with these Terms.
Product InformationWe try to provide accurate product information, images, prices, and availability. Errors may occur. We reserve the right to correct errors, update information, or cancel orders affected by incorrect information, to the fullest extent permitted by law.
Intellectual PropertyFondCircle and its licensors own all rights, title, and interest in the Services, including the FondCircle name, logo, trademarks, service marks, product names, software, app, website design, text, graphics, and other content we create or license ("FondCircle Content").
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any FondCircle Content, except as permitted by these Terms or with our prior written consent.
Nothing in these Terms transfers any FondCircle intellectual property rights to you. Feedback and suggestions you provide are addressed in the "Feedback, User Content, and Reviews" section below.
Shipping, Returns, and WarrantyShipping is governed by our Shipping Policy.
Returns and refunds are governed by our Return Policy.
Eligible devices are covered by our Warranty Policy.
App and Connected Device FeaturesSome FondCircle products may connect to the FondCircle App or supported third-party platforms. App features may depend on device compatibility, permissions, account status, connectivity, subscription status, and feature availability.
We may update, change, suspend, or discontinue app features at any time, at our sole discretion, with or without notice, where permitted by law. Material changes to paid subscription features will be handled in accordance with our Subscription Terms and applicable law.
App and connected device features may include, but are not limited to, measurement history, trends, reminders, AI-generated health summaries, AI Chat, and trend or risk highlights. Feature names, availability, and supported data types may change as the App evolves.
Informational Health Use OnlyFondCircle products, app features, and all related services — including but not limited to device readings, trends, summaries, reminders, AI-generated health summaries, AI Chat, trend or risk highlights, and AI Health Insights — are intended for informational and wellness purposes only.
They are not medical advice, diagnosis, treatment, prevention, cure, emergency support, clinical opinion, or a substitute for a qualified healthcare professional.
Do not ignore or delay professional medical advice because of information from FondCircle products or services.
If you believe you may have a medical emergency, call emergency services immediately.
Device Readings and User ResponsibilityYou are responsible for using devices according to the instructions, manuals, warnings, and intended use information provided with the product.
Readings can be affected by setup, fit, user technique, device condition, environment, accessories, consumables, and other factors. Discuss medical questions or unexpected readings with a qualified healthcare professional.
AI Health InsightsAI Health Insights and similar features may include, but are not limited to, AI-generated health summaries, AI Chat, trend summaries, and risk highlights. These features are designed to help you organize records, review patterns, and understand information from supported FondCircle products and app features.
AI features do not diagnose conditions, interpret symptoms, recommend treatment, provide medical advice, or provide clinical opinions. AI outputs may be incomplete, outdated, inaccurate, or not appropriate for your specific situation. Do not use AI outputs to make medical decisions, medication decisions, treatment decisions, or urgent health decisions.
AccountsYou are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@fondcircle.com if you believe your account has been compromised.
Account Suspension and TerminationWe may suspend or terminate your account, or your access to part or all of the Services, at any time with or without notice if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive activity, or if required by law.
You may close your account at any time by contacting support@fondcircle.com. Account closure does not affect any rights or obligations that arose before closure, including outstanding orders, warranty claims, or payment obligations.
SubscriptionsFondCircle Premium or other subscription features, if offered, are governed by our Subscription Terms and by the applicable app store or payment provider terms.
Subscription features, pricing, renewal rules, cancellation rules, refund handling, discounts, and other material terms will be shown in the App, applicable offer screen, checkout flow, or Subscription Terms.
Feedback, User Content, and ReviewsFor purposes of these Terms, "Feedback" means ideas, suggestions, comments, technical input, product requests, survey responses, or other non-confidential input you provide about FondCircle products, services, features, business, or user experience. Feedback does not include personal information, health records, device readings, app account data, private support materials, or content you submit specifically for public display, such as reviews, testimonials, photos, videos, or social media posts.
To the fullest extent permitted by law, Feedback you submit becomes FondCircle's exclusive property. If any rights in Feedback cannot be assigned, you grant FondCircle an unrestricted, perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, and sublicensable license to use, copy, modify, adapt, publish, distribute, disclose, redistribute, create derivative works from, commercialize, or otherwise exploit the Feedback for any purpose, without notice, review, approval, return, attribution, or compensation to you.
Feedback is not treated as confidential. FondCircle is not obligated to review, implement, keep, return, protect, or destroy Feedback you submit.
If you submit reviews, images, comments, testimonials, photos, videos, social media posts, or other content for public display or community, marketing, promotional, or review-related use ("Public User Content"), you confirm that you have the rights needed to submit that Public User Content and that it does not violate another person's rights. If your Public User Content identifies or includes another person, you are responsible for obtaining any permission required to submit and share it.
You keep ownership of Public User Content you submit. By submitting Public User Content, you grant FondCircle a worldwide, non-exclusive, royalty-free, perpetual, transferable, sublicensable license to host, store, reproduce, copy, edit, adapt, translate, publish, display, distribute, create derivative works from, and otherwise use that Public User Content in any media or channel for purposes including operating, supporting, improving, marketing, and promoting the Services. This license survives account closure or termination with respect to content already published, distributed, or incorporated into FondCircle's materials.
Do not submit Feedback or Public User Content that is unlawful, misleading, infringing, abusive, private, health-sensitive in an inappropriate context, or otherwise inappropriate. We may, at any time and at our sole discretion, edit, reformat, excerpt, translate, refuse, remove, or decline to display Public User Content, including but not limited to content that is unlawful, misleading, infringing, abusive, private, health-sensitive in an inappropriate context, or otherwise inconsistent with these Terms.
This section does not override our Privacy Policy, App & Health Data Privacy Notice, or Cookie Policy. Personal information, including health records, device readings, and private support materials, will be handled according to those policies and not treated as Feedback or Public User Content simply because you provide them to the App, device, or support team.

Third-Party ServicesThe Services may link to or integrate with third-party platforms, app stores, payment providers, shipping carriers, health platforms, analytics tools, or other services. We are not responsible for third-party services, and your use of them is at your sole risk and may be governed by their own terms and policies.
Prohibited UsesYou may not use the Services to engage in any of the following conduct, including without limitation:
violate any law or regulation;
infringe or misuse intellectual property or privacy rights;
interfere with the security, integrity, or operation of the Services;
upload malicious code or attempt unauthorized access;
misuse health, device, or account features;
resell products without authorization;
make fraudulent purchases, returns, warranty claims, or support requests.
The above list is illustrative and not exhaustive. We reserve the right to determine, in our sole discretion, what constitutes a violation of these Terms.
DisclaimersTO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FONDCIRCLE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT FOR ANY EXPRESS WARRANTIES STATED IN OUR WARRANTY POLICY.
The Services are provided on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times. Nothing in this section limits or excludes any warranty rights you may have under our Warranty Policy.
IndemnificationTo the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless FondCircle Inc. and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or inability to use the Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit to the Services.
Limitation of LiabilityTo the fullest extent permitted by law, FondCircle will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to the Services.
To the fullest extent permitted by law, FondCircle's total cumulative liability to you for any claims arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid to FondCircle in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
Force MajeureFondCircle will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, labor disputes, government actions, export controls, port closures, supply chain disruptions, component or material shortages, carrier failures, cyberattacks, internet or infrastructure failures, or third-party service outages.
Governing Law and Dispute ResolutionThese Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and, to the extent permitted by applicable law, you consent to personal jurisdiction in those courts.
Before initiating any formal proceeding, you agree to contact us at support@fondcircle.com and attempt to resolve the dispute informally for at least thirty (30) days.
Severability and WaiverIf any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. A waiver of any provision in one instance does not waive the right to enforce it in the future.
Entire AgreementThese Terms, together with the policies referenced in them, constitute the entire agreement between you and FondCircle regarding the Services and supersede all prior agreements, understandings, or representations relating to the same subject matter.
Changes to These TermsWe may update these Terms from time to time. Changes become effective immediately upon posting unless we indicate otherwise. The updated version will be posted with a new "Last updated" date. Continued use of the Services after changes are posted means you accept the updated Terms.
