FondCircle products and app features may involve health and wellness-related information. We treat this information with heightened care and use it only for the purposes described in this Privacy Policy and any supplemental notice presented to you when you use a specific feature.

1. Definitions
Personal Information means information that identifies, relates to, describes, or can reasonably be linked to a specific person.
Health and Wellness Data means personal information relating to your health, wellness, body measurements, device readings, app records, activity, sleep, medication reminders, or connected health integrations. This category may be treated as sensitive under applicable privacy laws.
Device Data means information about a FondCircle device, mobile device, browser, or connected hardware — such as model, identifiers, firmware version, operating system, connection status, error logs, and diagnostic data.
Aggregated or De-identified Data means information that has been processed or combined such that it cannot reasonably be linked to any specific individual.
2. Scope
This Privacy Policy covers:
- the FondCircle website and online store at
fondcircle.com; - purchases, shipping, returns, warranty claims, and customer support;
- product registration and account management;
- marketing communications, newsletters, surveys, SMS/MMS programs, and promotions;
- the FondCircle App, supported connected devices, and health integrations at a high level.

Certain other features — such as family profiles, AI Health Insights, and third-party health integrations — may have additional disclosures presented to you at the point of use.
3. Information We Collect
The information we collect depends on how you interact with FondCircle.
3.1 Information You Provide to Us

3.2 Website and Ecommerce Data
When you visit fondcircle.com, we automatically collect:
- network identifiers such as IP address and approximate location derived from it;
- browser type, device type, operating system, language, and time zone;
- pages viewed, products viewed, search terms, links clicked, cart and checkout activity, and referring pages;
- cookie, pixel, tag, log file, analytics, and fraud-prevention signals.
We use this information to operate the website, load content correctly, understand performance, improve the shopping experience, measure marketing effectiveness, and detect fraud.
3.3 App, Device, and Health Data
If you use the FondCircle App, supported connected devices, or health integrations, we may collect:
- Profile data: name, date of birth, gender, profile photo, email, phone number, postal code, country;
- Health and Wellness Data: depending on the devices and app features you use, this may include height, weight, body fat percentage, blood pressure, blood glucose, oxygen saturation (SpO₂), body temperature, heart rate, HbA1c estimates, sleep data, activity data, medication reminders, and other measurements generated by FondCircle devices or entered manually;
- Device Data: device model, manufacturer, firmware version, operating system, MAC address, serial number, device identifier, app version, battery status, and error logs;
- Connectivity signals: Bluetooth and Wi-Fi signals needed to pair and sync devices; location-related signals only where you have granted permission and the feature requires it;
- Third-party integration data: information from health platforms, devices, or apps you choose to connect (such as Apple Health or Google Health Connect), subject to the permissions you grant those platforms.
3.4 Information from Third Parties
We may receive information from:
- ecommerce, payment, and fraud-prevention providers (such as Shopify and payment processors);
- shipping and fulfillment carriers;
- advertising and analytics platforms (such as Google Analytics), subject to your cookie choices;
- app stores and mobile billing platforms;
- third-party health platforms, device manufacturers, or apps you authorize;
- customer support and communication tools;
- public sources or business partners where permitted by law.

5. Health and Wellness Data
Health and Wellness Data is sensitive. We apply the following commitments:
- Purpose limitation. We use Health and Wellness Data only to provide the features you have activated — such as device sync, reading history, trend visualization, reminders, record review, and in-app summaries — and for product improvement using de-identified or aggregated data.
- No advertising use. We do not share your Health and Wellness Data with advertising or marketing partners. Marketing partners may receive general account identifiers (such as a hashed email address) to enable ad attribution, but never your health readings or wellness records.
- No selling. We do not sell your Health and Wellness Data to any third party.
- No AI training. We do not use your Health and Wellness Data to train AI or machine learning models without your explicit opt-in consent.
- De-identification for research. We may use de-identified or aggregated population-level data for internal research, product improvement, and public health insights. This data cannot reasonably be re-linked to you.
Medical disclaimer. FondCircle products, readings, trends, summaries, and AI-generated insights are for informational and wellness purposes only. They are not medical advice, diagnosis, treatment, prevention, cure, or a substitute for consultation with a qualified healthcare professional. In a medical emergency, contact emergency services immediately.
6. AI Health Insights
If AI Health Insights or similar features are available, they may help summarize patterns, flag notable trends, or provide context for your readings.
These features are informational only and must not be used as the basis for any diagnosis, medication decision, treatment choice, or emergency response.
We do not use your Health and Wellness Data to train the underlying AI models powering these features.
7. How We Share Information
We do not sell your personal information. We may disclose information to the following categories of recipients for the purposes described.

Opting out does not mean you will stop seeing FondCircle ads — it means ads will no longer be targeted based on your browsing behavior.
You may also manage cookies through your browser settings or any cookie preference tool available on the website. Disabling certain cookies may affect site functionality such as cart persistence and checkout.
We do not alter our practices in response to Do Not Track browser signals, as there is no universally accepted standard for how such signals should be interpreted.
9. Automated Decision-Making
We do not use fully automated decision-making processes that produce legal or similarly significant effects on you.
Our ecommerce platform (Shopify) uses limited automated fraud prevention tools — including temporary blocks on IP addresses and payment methods flagged as high-risk — to protect the integrity of transactions. These measures are operational safeguards and do not constitute decisions with legal effect.
If you believe you have been incorrectly affected by an automated process, contact support@fondcircle.com and we will review it manually.
10. Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this Policy, or as required or permitted by law.

Accounts that show no activity for an extended period may receive a notification before any action is taken on account status. Backup systems may retain data for a short additional period after deletion requests are processed.
11. Security
We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction — including encryption in transit and access controls.
No internet transmission, application, device, or storage system is completely secure. You are responsible for maintaining the confidentiality of your account credentials. If you believe your account or information may have been compromised, contact us immediately at support@fondcircle.com.
12. Children's Privacy
The Services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from anyone under 18.
If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@fondcircle.com and we will promptly delete it.
Certain app features may allow a user to create profiles for family members or dependents. The primary account holder is responsible for ensuring appropriate permissions and consent exist for any dependent profile added to their account.
13. Your Privacy Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you;
- Correct inaccurate or incomplete information;
- Delete certain personal information;
- Receive a copy (data portability) of certain information in a structured format;
- Object to or restrict certain processing activities;
- Withdraw consent where our processing relies on your consent;
- Opt out of marketing communications, behavioral advertising, or certain data-sharing practices.

We may retain certain information where required or permitted by law — for example, for fraud prevention, legal compliance, tax, accounting, dispute resolution, or warranty purposes.
We will not discriminate against you for exercising your privacy rights.
California Residents (CCPA / CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act:
- Right to Know: request disclosure of the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the categories of third parties we share it with;
- Right to Delete: request deletion of personal information we hold about you, subject to certain exceptions;
- Right to Correct: request correction of inaccurate personal information;
- Right to Opt Out of Sale or Sharing: we do not sell your personal information, and we do not share Health and Wellness Data for cross-context behavioral advertising;
- Right to Limit Use of Sensitive Personal Information: you may direct us to limit our use of sensitive personal information (including Health and Wellness Data) to purposes necessary to provide the Services;
- Right to Non-Discrimination: we will not deny you goods or services, charge different prices, or provide a different quality of service because you exercised a privacy right.
Sensitive personal information we may collect (California definition): account credentials, Health and Wellness Data, and precise geolocation where you have granted permission.
Shine the Light: California residents may also request information about disclosures of personal information to third parties for their direct marketing purposes during the prior calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.
To submit a California privacy request, email support@fondcircle.com. Authorized agents may submit requests on your behalf with written authorization. We will respond within 45 days, extendable by an additional 45 days where reasonably necessary.
EEA and UK Residents (GDPR / UK GDPR)
If you are located in the European Economic Area or United Kingdom, we process your personal information on the following legal bases:
- Performance of a contract — to process your order, fulfill purchases, and provide account services;
- Legitimate interests — for fraud prevention, security, website analytics, and improving our products, where those interests are not overridden by your rights;
- Consent — for marketing communications, health data processing, optional integrations, and AI features;
- Legal obligation — to comply with applicable laws and regulations.
For Health and Wellness Data (which may constitute "special category" data under GDPR), we rely on your explicit consent or other applicable Article 9 exemptions.

You may lodge a complaint with your local data protection authority if you believe we have processed your information unlawfully.
14. International Data Transfers
FondCircle is based in the United States. If you are located outside the United States, information we collect may be transferred to, stored, and processed in the United States or other countries where our service providers operate.
Our ecommerce platform, Shopify, initially processes order and store data on servers located in Ireland, before transferring it to Canada and the United States. Other service providers may process data in additional countries.
When transfers of personal information from the EEA, UK, or other jurisdictions with cross-border transfer restrictions are required, we and our service providers use appropriate safeguards — such as Standard Contractual Clauses or other legally recognized mechanisms — to protect your information.
15. Third-Party Links and Services
The Services may include links to third-party websites, app stores, payment providers, health platforms, or connected services. Their privacy practices are governed by their own policies, which we encourage you to review before providing information or connecting accounts. We are not responsible for the privacy practices of third parties.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other operational reasons. The updated Policy will be posted with a new "Last updated" date. For material changes, we will provide additional notice — for example, by email or a prominent notice on the website — before the changes take effect.
